Chapter 13
Chapter 13 allows any individual from states to file the bankruptcy
for saving their home from foreclosure. The designated authority would
not go ahead with their home foreclosure proceedings. The petition filed
applicant is also known as debtor, would seek mortgage repayment extensions.
The debtor would get special benefit like lower monthly payment plans.
This chapter is mostly suitable for any individual either doing job or
business, he or she would be instant eligible from any creditors demand.
The debtor would have to go throw the same judicial procedures offered
for other bankruptcy fillings. One has to file the petition in the nearby designated
bankruptcy court and submit all the documents. You should submit your monthly
earning details, monthly expenditures (housing tax, child education fees, living
and food costs, etc), number of creditors and their credit amount and nature
of each creditor’s borrowing. The data should be filled along with the
filling application form. You must pay the court fees and administrator charges
while submitting the documents to the court clerk.
The special bankruptcy court judge would have every right to accept
and reject your filling claims and may ask for additional documents.
The court would appoint a trustee for further examining your filling.
The debtor could file the bankruptcy along his/her husband or wife. Such
filling is known as co-applicant filling and the co-applicant details
should be submitted too, both applicants would be benefited from Chapter
13. The co-applicant would be automatically protected from any creditor’s
demand and ongoing loans. The creditor can’t threat or give repayment
time-frame to any of the applicant. Also, the credit would communicate
via appointed trustee. This chapter gives better protections to any individual
suffering from cash crunch. The creditor could repay the loans according
to his budget and maximum period of time. The bankruptcy court may grant
the repayment duration to 5 years. Such extension would be very much
beneficial for the debtor.
Small and large organizations are not allowed; only small business owner
could be benefited from any sudden business loss. Most updated data reveled
that unemployed individuals are most likely to file the chapter13.
Once the court approved the petition the court clerk would send notifications
to every creditor stated by the petitioner in his filling. Please be
